Etsystant Terms of Service
Last updated: 14 September 2026
1. About Etsystant
Etsystant is a business registered in Ireland under business name registration number 782847.
These Terms of Service govern your use of the Etsystant website and the services provided by Etsystant.
By using this website or purchasing or using an Etsystant service, you agree to these Terms of Service.
If you do not agree with these terms, please do not use the website or services.
2. Our Services
Etsystant provides AI-powered business automation and AI Employee solutions designed to help businesses respond to enquiries, capture leads, provide customer support, and manage tasks such as appointment booking.
The specific features, functionality, configuration, and services provided to a customer may vary depending on the service selected and the customer's requirements.
A service description, quotation, proposal, or other written agreement may contain additional terms that apply to a particular customer or service.
3. AI Employee Services
Etsystant uses artificial intelligence and automated technologies as part of its services.
AI-generated responses may occasionally be inaccurate, incomplete, outdated, or inappropriate. AI Employees should therefore not be treated as a substitute for professional human judgement where human review is necessary.
Etsystant does not guarantee that an AI Employee will respond correctly to every enquiry, successfully book every appointment, capture every lead, or operate without interruption.
Customers remain responsible for reviewing and appropriately configuring their AI Employee and for determining how the service is used within their business.
4. Website Use
You agree to use the Etsystant website and services lawfully and responsibly.
You must not:
use the website or services for unlawful, fraudulent, abusive, or harmful purposes;
attempt to gain unauthorised access to systems, accounts, or data;
interfere with or disrupt the website or services;
introduce malicious software or other harmful code;
use the services to violate the rights of others; or
use the services in a way that could damage Etsystant or its service providers.
Etsystant may restrict or suspend access where reasonably necessary to protect its services, systems, users, or customers.
5. Customer Responsibilities
Customers are responsible for providing accurate information required to configure and operate their services.
Customers are also responsible for ensuring that their use of Etsystant services complies with applicable laws and regulations, including any data protection, consumer protection, advertising, or sector-specific requirements applicable to their business.
Customers must not provide or instruct Etsystant systems to process information where doing so would be unlawful or outside the agreed service.
6. Payments and Subscriptions
Where a service requires payment, the applicable price and payment terms will be communicated before the purchase or subscription is completed.
Payments may be processed through third-party payment providers such as Stripe or Square.
Where a service is provided on a subscription basis, the applicable subscription price, billing frequency, renewal arrangements, and cancellation terms will be communicated at the time of purchase or in the applicable service agreement.
Any applicable taxes or charges will be handled as required by law.
7. Demos, Quotes and Orders
A free or paid demonstration does not automatically create an obligation to purchase a service.
Where Etsystant provides a quotation or proposal, the quotation may specify the services, price, implementation arrangements, and other applicable terms.
A service agreement or order may contain terms that supplement or take precedence over these general Terms of Service for that particular service.
8. Intellectual Property
Unless otherwise agreed in writing, Etsystant retains ownership of its website, branding, software, systems, templates, processes, materials, and other intellectual property used to provide its services.
Customers retain ownership of content, materials, information, and other intellectual property that they provide to Etsystant.
Customers grant Etsystant the permissions reasonably necessary to use customer-provided materials for the purpose of providing the agreed services.
9. Third-Party Services
Etsystant may rely on third-party services and technology providers to operate or support its website and services, including hosting, automation, artificial intelligence, email, payment processing, and other technical services.
Third-party services may have their own terms and privacy policies.
Etsystant is not responsible for failures or changes to third-party services outside its reasonable control.
10. Availability and Changes
Etsystant will make reasonable efforts to keep its website and services available and functioning, but continuous or uninterrupted availability cannot be guaranteed.
Etsystant may modify, improve, suspend, or discontinue parts of the website or services where reasonably necessary, including for maintenance, security, technical, or business reasons.
Where a change materially affects an active paid service, Etsystant will seek to provide reasonable notice where appropriate.
11. Cancellation and Refunds
Any cancellation or refund rights applicable to a particular service will be communicated at the time of purchase or in the applicable service agreement.
Nothing in these Terms of Service is intended to exclude or limit any rights that cannot legally be excluded or limited under applicable Irish or European Union law.
12. Limitation of Liability
To the extent permitted by law, Etsystant will not be responsible for indirect or consequential losses arising from the use of the website or services.
Etsystant does not guarantee that the services will meet every business requirement, produce a particular financial result, generate a particular number of leads or bookings, or operate without errors or interruptions.
Nothing in these Terms of Service excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded or limited.
13. Data Protection and Privacy
Personal data collected through the website and services is handled in accordance with the Etsystant Privacy Policy.
Where Etsystant processes personal data on behalf of a business customer, additional data protection terms or a data processing agreement may apply depending on the nature of the service.
14. Suspension or Termination
Etsystant may suspend or terminate access to a service where reasonably necessary, including where a customer materially breaches these Terms of Service, uses the service unlawfully, fails to make required payments, or creates a significant security or operational risk.
Any termination rights applicable to a particular paid service may also be governed by the relevant service agreement.
15. Changes to These Terms
Etsystant may update these Terms of Service from time to time.
The latest version will be published on this website together with the date it was last updated.
Your continued use of the website or services after an update may constitute acceptance of the updated terms where permitted by law.
16. Governing Law
These Terms of Service are governed by the laws of Ireland, except where mandatory consumer protection or other applicable law provides otherwise.
Any disputes will be subject to the applicable jurisdiction of the courts of Ireland, subject to any mandatory legal rights available to consumers or other parties.
